Whether the court of appeals misapplied thestrict scrutiny standard in determining if Congress had acompelling interest to enact legislation designed to remedythe effects of racial discrimination. 2. Whether the UnitedStates Department of Transportation's current DisadvantagedBusiness Enterprise program is narrowly tailored to serve acompelling governmental interest.
